One of the potential aspects for fair use is for the new work to not interfere or infringe on the marketability of the original work. Trump's Photoshop isn't going to compete with Rocky IV in any way on the market. Nobody is buying the picture, it just sits on the internet. Now if Trump tried to sell posters of his Photoshop, that would very likely become a violation, as it is now in competition with the original work. |

Berke Breathed who draws Bloom County had on his facebook page a photo of President Trump (and other politicians) wearing a Bill and Opus for president t-shirt. That was fine. Someone on his marketing team that didn't know better decided to use the photo on the merchandise page and that one came down real quick. Same shopped photo but different uses. If you do knowingly use a copyrighted image to profit without permission the owner of the copyright can sue for all profits plus a large fine. |
