The feds don't involve themselves in such things. I'm pretty sure that Mehul scripted the forum software from scratch ... so unless he sues, it's all BS.

I think his rules are wishful thinking, but as far as copyright infringment there may be a case.

I would imagine that OMAC now owns all of Swirve's copyrights and they could force the server to shut down this forum without notice.

So they make a complaint, we change the banner. They won't get anywhere with a lawsuit for something this silly if TC hasn't even recieved a complaint from Omac first. At least, not in Europe. That said, the logo still needs some work.

If they want to be nasty all they have to do is have their lawyers contact our server and tell them to shut us down.

I seriously doubt that. And what countries laws are they following anyway? Not US. Its all EU now. I'm pretty sure that a judge over here would say this is too silly, its a small non profit chat site, tell them to change the logo. If they still don't, get back to me. Since there is no litigation issues in Europe, the legal system actually tries to recommend and help small claims parties to resolve things before it gets to court.

Fuck... Hot Rod, they can do whatever they want but:

A) Lawyers are expensive and their time is extremely valuable. No one anywhere would spend $1000 to have their lawyers get a court order to shut down this site. Dont be ridiculous.

B) Forum colors and styles are not subject to copyright. Furthermore, just using the name "Swirve" or the picture is not going to get you into trouble. There has to be some kind of damage claim being made in order for a lawsuit to go anywhere. I can say Kelloggs, Pepsi, Visa, or Yahoo.com whenever and wherever I want without worrying about those companies coming after me. Its generally only if I try to use their logo on a similar product, etc...

C) It is obviously a troll. Otherwise it would be a moderator posting the message and the message would be sticky and/or locked. Stop BEING A GOD DAMN MORON.

The coding is different, Mehul coded the other site from scratch.

The Banner was never actually copywritten by Swirve, either.
The best they can do is request we change it.

Now imagine this site was properly open to goolge web crawlers, and you typed "OMAC" or "Jolt".

Now imagine you are going to advertise on OMAC and jolt, and you google search them.

There are other lines open to them than copyright infringement.
