New York Governor Andrew Cuomo said his administration plans to sue the federal government over the new Republican tax law, on the grounds that it’s unconstitutional because it discriminates against New York and other states that voted against President Donald Trump.

“Make no mistake, they’re robbing the blue states to give money to red states,” Cuomo said during his State of the State speech in Albany Wednesday. “It is an economic civil war. It is illegal and we will challenge it in court as unconstitutional.”

Cuomo, who described the Trump presidency as “the most hostile federal administration in history,” said the changes to state and local tax deductions in the bill will raise New Yorkers’ property and income taxes by at least 20 percent. The governor added that New York state already contributes $48 billion more annually to the federal government than it gets back.

Critics of the state and local tax deduction have said the break effectively lets the federal government subsidize high-tax states. The bill signed by Trump on Dec. 22 sets a new $10,000 limit on state and local tax deductions for federal income taxes starting on Jan. 1.

The impact of the tax law “is a question of New York’s economic viability long term, a question of New York’s competitiveness long term,” Cuomo said. “The threat from this federal government is not going to derail the great state of New York, I promise you.”

In addition to challenging the law as unconstitutional, Cuomo said he plans to start a campaign to repeal and replace the new tax law. And, he said he’s considering workarounds to respond to the changes, including restructuring New York’s current income and payroll tax system, and creating new opportunities for making charitable contributions to support public programs.

Well, he wants to be a potential democratic presidential candidate, best way to do that is to draw attention to himself by opposing trump. Using the term "economic civil war" is pretty hyperbolic but we live in hyperbolic times.

More like he is 1000% mad about how the tax code penalizes the blue states who tend to have higher tax rates then the red states who don't. Before this tax bill it was generally an accepted truism of federal authority that the revenue power of the National Government would not be used against the States. As such people have for decades now, been able to write off their dues to their State Government from what they owe the Federal Government. This notion was predicated on the belief of harmonious Union, where the States and the Feds were all just one Government really that everyone pays into for the good of all.

There has already been bad blood between States like New York, New Jersey and California with States like North Carolina, Tennessee and Georgia over the use of taxes to entice businesses away. Actions like this will only deepen the divide.

What the fuck is this kind of logic? Literally every single last type of taxation regime has its winners and losers, this one is no different in that regard.

-Support a progressive tax rate plan? That discriminates against high income earners.
-Support a flat rate plan? That discriminates against lower income earners.
-Estate taxes? They discriminate against high networth individuals.
-Sales taxes? They discriminate against spenders.
-Sin taxes? They punish sinners.
-Homeowner credits? They indirectly punish renters.
-Highway tolls? They disproportionately punish vehicle owners.
etc. etc.

This tax bill is a complete piece of shit, but there's zero legal ground for this fuckwit NY scumbag's argument. Cuomo's just trying to raise his national profile and score political points with his constituents, all the while tying up the tax law in the courts for a good couple of years.

Sorry, but this is made up fiction. The federal tax regime was never predicated on finding a harmonious balance with the states; it was always about being dominant against the states and only carving out exemptions where it was politically convenient to do so. The fact that federal tax law has been explicitly used to compel states to bend to the will of the politicians in DC (legal drinking age, anyone?) is ample evidence of this.

Ideologically, I agree with you that the states' own taxation schemes should be offset at the federal level, from a states' rights perspective if nothing else. But the federal government between circa 1933 and 2017 never gave a shit about states' rights when crafting its tax laws, and let's not invent that fantasy now.

Why would two people with the same income and living situations be taxed differently by the federal government based on state-level agendas?

Either federal agendas are a necessity or they aren't. If they aren't, then cut taxes across the board.

Does NY spending more on schools or subways reduce DoD outlays?
