Uh, pleading the fifth in a civil case is damning. It can and is taken as an inability to defend oneself. So yes, if Cohen is refusing to address Stormy's claims by pleading the fifth, you can interpret that as tacit admission of guilt. As long as Stormy's claim is reasonable (with evidence), and as long as Cohen doesn't defend himself via 5th amendment, he will be guilty of all of Stormy's claims.

In this case though the subject of the civil suit and a potential criminal case are related. So Cohen can in fact plea the fifth. So the civil case gets delayed and whatever comes out of the criminal case can then be used as evidence in the civil.

I never heard of the 5th being used in a civil case so I am unfamiliar with what the ramifications would be.

I do know that if the criminal case had reached a not guilty verdict taking the 5th would have no effect on the criminal case because of double jeopardy.

I am pretty much saying that. You "can" plea the fifth in a civil case, but its essentially an admission of guilt because the only way you can make it stick is if you actually committed a crime that would get you prosecuted. Since you basically have to convince the judge you've done things that could place you in legal jeopardy if you testify. Its a neat catch-22.

In this particular case though Cohen has far more leeway as there is already clear evidence he is in legal jeopardy due to the Governments own actions. Prenda law is in deep shit because they were not under criminal investigation before, but by pleading the fifth it attracted more attention. Its why most civil defendants with skeletons in the closet try to settle.

That is not what you said.

This is what you said. You said that you cannot normally plead the 5th in a civil case. That is absolute bullshit. You can. It just is tacit (as in, not through words, but we all understand that refusing to defend yourself is not good optics) admission of guilt as long as there is a reasonable amount of evidence.

This is wrong. Cohen could have plead the 5th whether there was a criminal case or not, as we can make pretty good conjecture that any relevant information given in the Stormy case would implicate him in an actual criminal matter (which is inadvertently ongoing). If the criminal case did not exist, Cohen would likely just lose the civil case and then everything would be done.


Also: see the Uber v. Waymo. Levandowski plead the 5th pretty early on in the case, without any pending criminal charges. Of course, evidence of criminal wrongdoing was eventually found and he's up on charges now. But he wasn't when he plead the 5th.



So, tldr: Aeros is wrong and now backpedaling. But it is good that he actually finally realizes you can plead the 5th in a civil case.

My understanding from reading the link Hood presented as well as comments by the composer at the end of the article.

Depending on the State and situation, inference of guilt statutes exist and Juries are instructed not to consider guilt when the defense invokes the 5th. Easy to say, eh?

I don't know enough about the case, but I suspect this one was forwarded for other reasons than a civil breach of contract. Never and always doesn't exist in court proceedings.

To an extent yes. Giuliani knows now the truth and knows that if Trump would ever testify under oath vs. what he said publicly this would be incredibly damaging. For it to be acknowledged and now revealed what it does is prevent Trump lying, or inadvertently lie because it is second nature to him.

What will now expose if there is any violations of campaign laws, which may be a little trickier to prove there was. So it is a better angle for them to work out of. It was a good move.

The only uptick is that it once again shows what many have been saying. Trump lies as water flows over the fall.

and because i let that video run while typing, i noticed him lying @ 2:30 about Mueller working for Obama for 8 years... & that the investigators are all Dems... then notes the Rosenstein letter about Comey & lies that viewers don't know about it (false)... we heard all about it, that's the fake excuse they used as reason for the firing yet he's on tape saying he would've fired Comey regardless of that letter, so he's going to lie about his rationale for the firing being that letter again...
