Man Sues CVS For Telling Wife He Had Viagra Prescription

The man said his “marriage has broken down” after violation of privacy rules.

A New York man claims the actions of a chatty CVS employee turned out to be unhealthy for his marriage.

Michael Feinberg is suing the drugstore chain for unspecified damages claiming he suffered “genuine, severe mental injury and emotional harm” after he took a prescription for Viagra to a Long Island CVS to be filled.

According to a lawsuit obtained by the New York Post, Feinberg told a store employee identified in court papers as “Aurula” that he would pay for the medicine himself ― a big investment, considering a single pill can cost $60.

A few days after that prescription was filled, Feinberg said, his wife called the CVS to discuss another prescription, only to have the on-duty pharmacist bring up the Viagra.

Feinberg said the employee “without solicitation, improperly informed [Feinberg’s] wife that [his] prescription for Viagra was not being covered by insurance,” a violation of HIPAA privacy rules, according to Fox News.

Feinberg, who calls his wife a third party who had no right to know about the drug, said, as a result of the CVS employee’s indiscretion, his “marriage has broken down,” according to the New York Post.

CVS spokesman Gary Serby released this statement to HuffPost:

“CVS Pharmacy does not comment on pending claims or litigation. We have policies and procedures in place to ensure that we provide medications to the correct patient.

“We also place the highest priority on protecting the privacy of those we serve, and we take our responsibility to safeguard confidential information very seriously.”

Yeah, that employee is fucked. CVS will probably have some penalties to pay, but as it is just a one time incident corporate probably won't be in for too much.

To be honest, the guy should have got his prescription filled somewhere else. Somewhere his wife did not use.

That isn't how protected health information works, HR. By working in healthcare, CVS has decided to abide by the rules surrounding holding patient information. One of the very clear rules surrounding it is getting permission from the patient on how information can be shared (i.e. with spouse, family, etc.) and giving patients access to any materials governing how CVS shares patient information.

Clearly CVS either did not get a release of information form from this patient or the pharmacist just completely ignored it. They fucked up. The patient is at absolutely no fault here.

hood, I agree with you 100% including your last paragraph.

I was just pointing out that if it were me I would have gone to a different pharmacist for the simple reason that I had no idea how the privacy regulations are.

I just would have avoided the same pharmacist I shared with my wife.

My wife and I regularly pick up prescriptions for each other. Who ever is going by the drug store when there is one to be picked up.

The druggist always ask if you need specific information on any prescription you pick up. You sign or indicate on their machine that you understand the prescription.

Stupid fuck should have picked up his own prescriptions.
