Not quite accurate. Towns in Northwest Territories and the Yukon can ban pot store, and if they do, anyone living in that town cannot purchase online.

Also, it's illegal to smoke it outside your home, so renters cannot legally smoke weed.

Can't grow plants if you rent either.


So, it's legal for homeowners and that's it.


I live in a city of over a million people. 2 dispensaries where approved in time for legalization.

In Ontario, you can only order online, so only legal for people with credit cards.




It's all sorts of fucked, hopefully the day comes where it really is legal.


Can't open a weed cafe either, since it can't be consumed where it's sold.

To be fair, American landlords in many jurisdictions have the right to ban smoking within their buildings. It is a fire hazard after all.

On the federal level, you're allowed to smoke anywhere except hospitals and schools and government buildings.

Then every province and municipality sets their own laws. Lowest level prevails on restrictions.

In Montreal, you can smoke anywhere you can smoke cigarettes. But each borough can set their own restrictions on that, so in some you can only smoke on private property.

There has been, at no level of government anywhere, any law passed to prohibit you from smoking weed in an apartment.

If your lease does not explicitly state no smoking, you're allowed.

I mean I'm not denying that smoking causes fires or anything... I just wouldn't be OK with that being part of a lease for renting property myself. And I don't think it would be legal here (though I'm no expert obviously... never heard of that being part of any lease until this thread in any case).

It has more to due with the damage that long term smoking can cause inside. The smoke eventually seeps into the walls.

I would think that non-smokers would prefer a building that doesn't allow smoking. We don't have any ashtrays in our house. I think the only smoker that comes here on occasion is my grandson and he steps outside to have a smoke. Of course we own the house, but if I were renting I would prefer a non smoking complex.

I never realized how bad rooms smelled that allow smoking until I quit 23 years ago. I went on a trip and got a motel. They only had smoking rooms available and I said OK. When I stepped into the room it was like walking into a dirty ashtray. It looked clean but the smell permeated everything.

As of now, no, they can't stipulate that in a lease afaik and they can't tell you not to now (as it'd require amending the lease) . It's akin to saying you can't have house plants, for now. I'm sure their challenges will succeed at least in part.

Landlord associations the nation over are trying to amend rules, either to allow themselves to ban growing or to disallow it & weed smoking in apartments in general.

You can drink in public in some parks in Montreal. On Mount royal for example and in little Italy and Saint henri there are parks that allow drinking so long as you have food
