FERNDALE (WBFF) -- Anne Arundel County Police are investigating an officer-involved shooting that occurred Monday morning in Ferndale.

Police spokesman Jacklyn Davis said officers responded to 103 Linwood Avenue at around 5:15 a.m. to serve an “emergency risk protective order,” also known as the red flag order.

Police say Gary J. Willis, who was the subject of the Extreme Risk Protective Order and the Emergency Petition, answered the door armed with a handgun.

When officers began to serve Willis with the order, he became irate, opened the door to the residence and grabbed the gun according to police. They say, an attempt was made by an officer to take the gun away from Willis when Willis fired the gun.

A second officer fired their service weapon, striking Willis, who was pronounced deceased at the scene.

Davis says no Anne Arundel County officers were injured in the struggle. The suspect was pronounced dead on scene.

Davis says there were other adults in the home, but no other injuries were reported.

The Red Flag Law went into effect on October 1 and allows judges to create protective orders against a gun owner who has displayed certain threatening behaviors.

The 'red flag' legislation is already law in five states- including California, Connecticut, Indiana, Oregon, and Washington. It has been introduced in 18 states and D.C.

Guy fired his own weapon. Probably didn't need to be killed over it, but understandable that gunfire from an agitated person who is directly interacting with police results how it did.

i don't know that law but sounds like cops were following it... of course they are providing the story so not that surprising :p

are they allowed to enter the home w/o permission? seems a bit suspicious they note the guy opened the door, but maybe he went outside initially... i dunno

So one of five adult family members can get pissed off, call the cops and get a railroaded bench order to seize weapons, and the cops will show up at 5am ready to bark orders.

Meanwhile, the other four family members are sleeping soundly, clearly unworried at the state of affairs.

Ya probably know this but it doesn't quite work that way. The police visit the night before should be your first clue.

You are going to have to call the police twice.

= How does it work?

A petition must be filed in court to explain the potential dangers.

A judge will need specific reasons why the person in question might harm themselves or someone else.

The petition also must include things, such as, how many guns the person has and where the weapons are.

If approved, a judge has the authority to take someone’s guns away within hours when someone sounds the alarm.

The details would be sorted out in court within a couple of weeks.

There are only a handful of people allowed to do file petitions under the new law.

- Law enforcement
- Health professional
- Spouse or family member
- Someone the person is dating or has children with
- Current or former legal guardian


If a petitioner is found to be making false claims or embellishing the truth, they could face perjury charges and jail time.
