HOUSTON - The Houston Police Department position is clear: 7800 Harding St. was a drug house where black tar heroin was sold -- and where the homeowner opened fire on, and injured, several undercover officers on Monday.

But something doesn't add up for those who know the neighborhood and knew the suspects best.

Robert Antu moved across the street from Dennis Tuttle about 30 years ago, before he was married, and considered Tuttle a dear friend.

"If he would have known it was police, he would have never shot," Antu said. "No way. He obeyed the law. I tell you, he was a straight-up guy."

Houston police said Tuttle emerged from a back room of the house and shot four undercover officers after they broke open his front door and shot and killed his pit bull that had charged at them.

The officers returned fire, killing Tuttle and his wife, Rhogena Nicholas, who police said approached an officer during the shootout and reached for his weapon.

"(Nicholas) called me and she told me that she loved me" the morning before the shooting, said neighbor Esmerelda Becerra said, nearly in tears.

Both women had cancer and were friends for 21 years, Becerra said.

"Do you know how I felt?" said Becerra, crying. "There's no more tears in me. I went over there to go leave flowers. I almost fainted."

"They didn't deal drugs from out of that house," said another neighbor, who grew up with Tuttle and Nicholas. "They're not those type of people."

In a search of the house after the shootout, Houston police found marijuana, an unknown white powdery substance, several shotguns and a rifle.

Tuttle was once a Marine who struggled with a variety of physical and mental health issues, many neighbors and Tuttle's sister said.

"I want to say that our prayers are with the officers and their families who were affected," said Elizabeth Ferrari, Tuttle's sister.

She drove down from the Dallas area after she heard the news.

"It’s a very tough situation," Ferrari said. "I do not know any details other than I came here hoping that it was incorrect."

Seems about 50/50 now, maybe more. Honorably discharged vet, married to his wife for 20 years, she had cancer, cops only found pot + some "mysterious white powder". No black tar heroin.

Gonna laugh cynically if this was a case of wrong address. Don't think HPD will admit it though, not with 4 cops shot.

HOUSTON (AP) — A lead investigator lied in an affidavit justifying a drug raid on a Houston home in which two residents were killed and four undercover officers were shot and wounded during a gun battle, the city’s police chief said Friday.

In the search warrant that was used to justify entering the home, officers with the Houston Police Department’s narcotics unit had alleged that a confidential informant had bought heroin at the house the day before the Jan. 28 raid. The informant had also allegedly seen a handgun in the home.

But according to an affidavit filed as part of the ongoing investigation into the raid and made public Friday, the informant told investigators he or she had not bought any drugs at the home and had not been involved in any work leading up to the raid.

The heroin allegedly bought at the home had been obtained elsewhere, according to the affidavit.


Investigators also spoke with several other informants who had previously worked with Goines and all said they had not bought drugs at the home, according to the affidavit.

After the raid, police said they found several firearms at the home, along with marijuana and cocaine but no heroin.

Houston Police Chief Art Acevedo said the ongoing investigation into the drug raid appears to have uncovered “some untruths or lies” in the search warrant. He called this “unacceptable.”

“When we prepare a document to go into somebody’s home ... it has to be truthful, it has to be honest, it has to be absolutely factual,” Acevedo said. “So, we know already there’s a crime that’s been committed. A high probability there will be a criminal charge.”


Authorities still believe Tuttle and Nicholas were involved in criminal activity, but Acevedo said the case now is undermined.
