He didn't base this on the 2nd amendment. Our entire judicial system is basically based on you can't take something away from someone or punish someone for what they might do.

If they really wanted to try and solve the problem they would concentrate on the why instead of the how. Why is harder to explain and not easily polarized for re-election so they concentrate on the how.
