It's because

1. They dont want to have words on record to use against them and make it more unpalatable whrn they do it.

2. They dont want to say no and discourage their base.

3.They will likely play it ny ear but want to pack the court.

Biden doesn't want to pack the court but he can't lose the votes of the Bernie Bros.

And he basically plagiarized his answer from Nancy from when she said we need to pass the bill to see what is in it. The idea was changed enough to fit his situation but his handlers basically gave him the same answer Nancy gave us.

Even if Biden personally doesnt want to back the court, I doubt hes going to the one directing policy in his administration.

Also, if he wins, then we're likely to get President Harris by 2022 or so. And she absolutely wants to courtpack.

Biden would have to veto expanding federal courts if the legislatures decide that is what they want to do.

All perfectly legal if the plan has the votes for it. Sorry that the conservative supreme court for a generation seems to have a slight flaw in practice.
