The result would have been the same though: she did in fact break the law. The sentence:

"She was handed a three-month conditional discharge instead of a fine, but also ordered to pay a £26 victim surcharge."

The issue is with DVLA who could have dropped the prosecution on notification of the typo. They have, as per your story, since agreed if it's just a typo to petition to have the conviction quashed.

It's also appropriate that - even with the typo - drivers should be liable. If she ran a pedestrian over and put them in a wheelchair, she would have no insurance cover, and that person would receive no adequate compensation. Certainly, itn isn't malicious that she made a mistake but even such errors carry liability. DVLA ought to be pursuing these cases, though it can always act leniently for a first offence.
