She would have to kill herself at that point. So just get it over with. More importantly: There's no sane society where she would ever be trusted. You seem to get that with stand your ground legislation when Japanese students get killed. The case boils down to if the defence can prove that the woman was incapacitated by mental illness to a degree that meets the legal threshold. It seems that enough jurors were convinced this is the case. Get rid of hung jury rules or professionalize the juries if you think being judge by peers is problematic. In the meantime, you have the system that you have. |

The reasoning no doubt to sway the jury by facts in the hopes that feeling would counter the insanity defence. A long shot? I dunno. 25% of insanity plea defences are successful statistically speaking (Insanity pleas are made in 1% of criminal trials overall). But the proof is in the pudding. It does not look like there will be a conviction. |

A manslaughter charge covers the fact that she did kill the children, but without the intent to do so in a legal sense. The judge instructed the jury to consider a manslaughter conviction. The problem of course is that it may be too late. Innocent by virtue of insanity also applies to manslaughter. So if jury members are convinced of that defence at this point, then it would be hard to backtrack to manslaughter. |

Majority of the jury deciding would be one way to fix it. Commonlaw does not really scale up to even state level very successfully. It was designed for much smaller and transparent social settings. |

Professionalize the jury system or get rid of hung juries. The travesties you keep on suggesting are gender or race based apartheid. They have nothing to do with democracy and the rule of law and everything to do with trying to maintain white male privilege. Feel under siege? Grow a pair. |
